Explination of "Case Law" in Criminal Law

"Case Law" simply means the law that is established by prior court decions, typically prior appellate court decisions. The legislature creates the law and the appellate courts interprete that law. Case law also includes decsions based upon Constitutional rights. Case law plays a vital role in defending those accused of crimes and since courts are continously issuing new opinions it is important to hire an attorney that reads the opinions that come out of the appellate courts.
